IMPORTANT – PLEASE READ:

By accessing, registering with, or using RV Home Space in any way, you are entering into a binding legal agreement with RV Home Space, LLC. If you do not agree to every part of these Terms, you are not permitted to use the platform.

1. Overview

RV Home Space, LLC (“RV Home Space,” “we,” “us,” or “our”) provides an online marketplace that enables property owners (“Hosts”) who offer stationary RV spaces or RVs to list those spaces and enables individuals (“Guests”) to search for, request, and book those spaces. These Terms govern your use of the website, mobile applications, and related services (the “Platform”).

These Terms incorporate related policies and documents, including our Privacy Policy, Fees Policy, Cancellation Policy, and any other policies posted on the Platform. Your use of the Platform is subject to all applicable terms and policies.

2. Our Role

RV Home Space is a platform that facilitates listings and payments between Hosts and Guests. We do not own, manage, or control the listed spaces or RVs, and we are not a landlord, property manager, broker, insurer, or agent for any Member. Contracts for reservations are formed directly between Hosts and Guests.

3. Eligibility

You must be at least 18 years old and have legal capacity to enter binding agreements to use the Platform. By registering or booking you represent and warrant you meet these requirements.

4. Searching and Booking

You may search Listings using filters such as location, dates, and amenities. When you book a Listing and receive a booking confirmation, a reservation contract is formed directly between you and the Host. The total price you agree to pay includes the listing price, applicable service fees, taxes, and any additional items identified at checkout. Guests are responsible for reviewing all listing details and house rules before booking.

5. Host Terms and Contracting

When a Host accepts a booking request or a booking confirmation is issued, the Host is entering into a binding contract with the Guest to provide the listed stationary RV space under the terms shown in the Listing and these Terms. Hosts set their price, availability, house rules, and cancellation policy and are responsible for complying with all local laws, zoning, and HOA rules.

6. Payments, Fees, and Payouts

Payments are processed through our payment processor (Stripe). RV Home Space facilitates payments but is not a bank. Hosts and Guests agree that RV Home Space (via our payment processor) may charge payment methods to complete bookings, collect fees, or resolve damage reports as permitted by these Terms. Service fees, payout timing, and payout methods are set out in our Fees and Payments policy.

7. Cancellations and Refunds

Refunds and cancellations follow the cancellation policy displayed on the Listing at the time of booking and any applicable Platform policies for disruption, rebooking, or force majeure. If a Host cancels or a Reservation Issue occurs, Guests may be eligible for rebooking assistance or refunds under our Rebooking and Refund policy.

8. Your Responsibilities and Assumption of Risk

Each user is responsible for their own acts and omissions and for the acts of any guests or invitees. You must comply with house rules and local law. Many activities carry inherent risks. You assume the risks associated with using the Platform and staying at Listings, including risk of injury, illness, property damage, or loss. You must investigate Listings for suitability prior to booking.

9. Insurance and Liability

RV Home Space does not provide insurance for Hosts or Guests. Each party should maintain appropriate insurance for property damage, liability, and other risks. To the fullest extent permitted by law, RV Home Space disclaims liability for injury, theft, damage, or loss arising from Listings or stays. Our liability to any user is limited to the amount of fees paid by that user to RV Home Space in the 12 months preceding the claim, to the maximum extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RV Home Space, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, your Listings, your bookings, or your breach of these Terms.

11. Prohibited Conduct

Users must not engage in illegal, fraudulent, discriminatory, or unsafe conduct. RV Home Space prohibits the moving, towing, or driving of RVs as part of any reservation through the Platform; all rentals are stationary only. Misrepresentation of Listings or attempts to bypass Platform policies is prohibited.

12. Content Ownership and License

Hosts retain ownership of their listing content. By posting content on the Platform Hosts grant RV Home Space a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display that content for operating, promoting, and improving the Platform.

13. Screening and Background Checks

RV Home Space does not perform criminal background checks or comprehensive identity verifications on every user. Hosts and Guests are responsible for vetting each other before confirming a booking and may use available Platform tools for verification where offered.

14. Account Suspension and Termination

RV Home Space may suspend or terminate accounts, remove listings, or restrict access at any time for policy violations, suspected fraud, safety risks, or other conduct deemed harmful to the Platform or community.

15. Taxes

Hosts are responsible for determining, collecting, reporting, and remitting any taxes applicable to their Listings, including lodging or occupancy taxes. RV Home Space will comply with tax collection and remittance only where required by law and as described in our Taxes policy.

16. Dispute Resolution; Arbitration; Class Action Waiver

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM (“DISPUTE”) WILL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION. YOU AND RV HOME SPACE EACH WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.

Arbitration will be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The arbitrator may award any remedy that would have been available in court.

BY AGREEING TO ARBITRATION, YOU AND RV HOME SPACE EACH WAIVE THE RIGHT TO FILE OR PARTICIPATE IN ANY CLASS OR COLLECTIVE PROCEEDING, WHETHER IN COURT OR ARBITRATION.

17. Warranty Disclaimer and Limitation of Liability

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, RV Home Space disclaims all warranties and limits liability as set out in Section 9 above.

18. Modification of Terms

RV Home Space may modify these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

19. Miscellaneous

If any provision is found unenforceable, remaining provisions will remain in effect. These Terms, together with incorporated policies, form the entire agreement between you and RV Home Space regarding the Platform.
